I don't know if this has been come up before. If so,I don't remember seeing it.
I was playing the Pender scenario in the new expansion games, and had my men charge a Union battery. They captured several guns, but by then their fatigue factor was either "tired" or "exhausted." They got to the last gun but couldn't capture it. They went past the gun to the caisson and then just stopped and stood there, with the caisson right in their line. The artillerists, meanwhile, just keep firing, same as normal, even though they're surrounded by enemy troops.
Now I imagine several hundred exhausted men would have no trouble capturing an artillery piece when they're right there. They certainly wouldn't stand there watching them shoot down their comrades. The same thing happened again later in the same scenario.
I have noticed it before in other scenarios but never thought to report it. Is this a bug? It's certainly not accurate historically or just by common sense.

chances are if they were just standing there they had surrendered....
Did they have a white (grey) flag beside them?

Alright the problem was that the men were tired and exhausted and could not run at them they need higher fatigue you need more than winded to attack artillery or charge anything I have had this problem numerous times in the past.I don't know if this has been come up before. Correct, they could not run at them, but they marched right through them, they were not routed or retreating.
Certainly not historically accurate, but also frustrating because the artillery can keep tearing up your men when they should be captured.
I hope this is something that can be fixed in a patch.
