Capturing Artillery

I don't know if this has been come up before. If so,I don't remember seeing it.
I was playing the Pender scenario in the new expansion games, and had my men charge a Union battery. They captured several guns, but by then their fatigue factor was either "tired" or "exhausted." They got to the last gun but couldn't capture it. They went past the gun to the caisson and then just stopped and stood there, with the caisson right in their line. The artillerists, meanwhile, just keep firing, same as normal, even though they're surrounded by enemy troops.
Now I imagine several hundred exhausted men would have no trouble capturing an artillery piece when they're right there. They certainly wouldn't stand there watching them shoot down their comrades. The same thing happened again later in the same scenario.
I have noticed it before in other scenarios but never thought to report it. Is this a bug? It's certainly not accurate historically or just by common sense.
